Rigathi Gachagua has filed a petition to stop the Senate from acting on the impeachment request from the National Assembly. Chief Justice Martha Koome has been asked to form a judicial panel to examine the issues raised. Gachagua aims to secure an order that halts any Senate progress on the impeachment.
Judge Mwita has set a hearing for Monday to discuss the matter. Rigathi Gachagua’s legal team is seeking a temporary order to block the Senate from proceeding the impeachment motion against him. Senior Counsel Paul Muite, who represents Gachagua, claims the motion is based on unproven allegations. He points out that the National Assembly did not conduct necessary public consultations.
Muite further argues that the impeachment does not meet the constitutional standards in Article 145(1). Gachagua challenges the legitimacy of the process, saying it lacked adequate public involvement. He faces accusations of divisive politics and undermining President William Ruto. However, he insists the motion is a personal attack, not a serious constitutional breach.
Judge Lawrence Mugambi has recognized the complexity of the case. He has referred it to Chief Justice Koome to establish a judicial panel.
