Kenyan High Court Halts Sh95.68 Billion Adani-Ketraco Deal

The Kenyan High Court halted a Sh95.68 billion deal involving India’s Adani Energy Solutions Ltd and the Kenya Electricity Transmission Company (Ketraco). The agreement aimed to build power transmission lines and substations. The court acted after the Law Society of Kenya (LSK) filed a case. This ruling marks the second setback for Adani after a previous block on its proposed lease of Jomo Kenyatta International Airport (JKIA).

LSK argued that both deals lacked public participation and transparency. President William Ruto defended the power deal, saying it would lower electricity costs and reduce reliance on taxes and debt. However, Justice Bahati Mwamuye suspended the Adani-Ketraco agreement, citing LSK’s claims of secretive procedures and insufficient public involvement.

The court also blocked Adani’s bid to lease JKIA. Justice John Chigiti ruled in September that leasing the airport would threaten a vital national asset. The LSK and the Kenya Human Rights Commission argued the deal went against public interest and good governance.

LSK highlighted its unanswered requests for details on Adani Energy Solutions’ financial health, public feedback, and legal advice from the Attorney-General. They raised concerns about private control over crucial infrastructure. The High Court will revisit the case on November 11 for further directions.
