Deputy President Rigathi Gachagua accused of forum shopping

Deputy President Rigathi Gachagua’s accusation of forum shopping. It is obtaining judicial orders to avoid impeachment.
During Monday’s mention of the respondents in the lawsuit in which the DP is seeking orders to prohibit the Senate from proceeding with the impeachment motion.  Lawyer Paul Nyamodi pointed out that the petitioner has comparable petitions pending before the court.

However, Gachagua’s lawyer, Paul Muite, stated that the petition before the court started when the National Assembly sent the resolution to the Senate. And therefore the impeachment is in two stages.

Muite stated that it is unfair to accuse the DP of forum shopping.

At the same time, the respondents in the complaint, including Senate Speaker Amason Kingi and the Senate, want the court to resolve the issue of jurisdiction before hearing the case. Deputy President Rigathi Gachagua accused of forum shopping.

According to them, the court lacks jurisdiction to hear and decide Gachagua’s case.

Muite claims the DP’s constitutional rights infringed, and only the court can save him from impeachment.

In an application for a certificate of urgency, Gachagua identifies at least ten grounds he believes used to support what he calls a shambolic, unfair, and vicarious assault on him.

He claims that the charges advanced by 282 MPs in the National Assembly were unfounded allegations, hearsay, and blatant lies.
